Explanation of Whispering Hills Documents

The documents that govern our area in order of authority are:
  1. Deed Restrictions - these go with the land and are rules regarding what may and may not be done within the area.

  2. Homes Association Articles of Incorporation - our state incorporation papers defining us as a corporation, where we are registered (Kansas) and why we exist.

  3. Homes Association Declarations - these go with the land and define the responsibilities of the Homes Association - what we as an association can and cannot do - what we are responsible for, method of providing funds (dues), our powers for enforcement of restrictions.

  4. Homes Association By Laws - define how we will operate - who can vote, what is a quorum, officers and terms, meetings, ability to establish committees, etc.

The highest level of document rules on any issue. For example, if how we vote is mentioned in the Bylaws where it says ABC, but is also mentioned in our Articles of Incorporation where it says DEF, DEF rules since the Articles are of higher authority.

Separate rules regarding the operational practices of the ARC and the Treasurer are also applicable.

THIS FORM OF THE HOMES ASSOCIATION DECLARATION IS A REFORMATTED, WORDPROCESSED DOCUMENT. IT IS NOT A COPY OF THE SIGNED AND RECORDED ORIGINAL. THE SIGNED AND RECORDED ORIGINAL IS ON FILE WITH THE COUNTY REGISTER OF DEEDS AND A COPY IS AVAILABLE FROM THE HOMES ASSOCATION. THE DOCUMENT BELOW IS PROVIDED FOR CONVENIENCE AND REFERENCE ONLY. HOME OWNERS ARE BOUND BY AND WILL BE EXPECTED TO COMPLY WITH THE TERMS OF THE SIGNED, RECORDED DOCUMENT.
